These terms apply when you use the Funday website and mobile app (together, the "Service"). By using the Service, you agree to these terms. If you do not agree, please do not use the Service.
What we offer
Funday is a directory that helps families discover kid-friendly events, places and activities. We provide the Service free of charge and for personal, non-commercial use.
Accuracy of listings
Listings are compiled from public sources and from venues and organisers, and are provided for general information only. Details such as dates, times, prices, opening hours and availability can change without notice. We do our best to keep listings current, but we cannot guarantee they are accurate, complete or up to date. Always confirm details directly with the venue or organiser before you travel.
Third-party events and venues
Events, places and activities listed on the Service are run by independent third parties. We are not the organiser of these events or the operator of these venues, and we are not responsible for them, for their safety, or for any bookings, payments or interactions you make with them.
Your use of the Service
You agree not to:
- Use the Service for any unlawful purpose or in breach of these terms.
- Copy, scrape, resell or redistribute our listings or content without our permission.
- Attempt to disrupt, overload or gain unauthorised access to the Service.
- Submit false, misleading, abusive or infringing content through our forms.
Intellectual property
The Funday name, branding, design and the way we compile and present listings belong to us or our licensors. Listing content may belong to the venues, organisers or sources it comes from. You may use the Service for your own personal use, but you may not reproduce it for commercial purposes without permission.
No warranty
The Service is provided "as is" and "as available", without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any listing is suitable for your needs.
Limitation of liability
To the extent permitted by law, Funday is not liable for any loss, damage or injury arising from your use of the Service or your reliance on any listing, including attending an event or visiting a venue you found through the Service. Nothing in these terms limits any rights you may have under the New Zealand Consumer Guarantees Act 1993 where it applies.
Changes
We may update the Service and these terms from time to time. When we change these terms, we'll revise the "Last updated" date above. Continuing to use the Service after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any dispute relating to them.
